The Risk of Going It Alone

Let’s be frank. Not everything you do requires hiring a lawyer. But far too often, we see folks taking a “let me do it alone” approach that results in them assuming far too much risk than is necessary. In particular, we’re talking about Americans buying or selling properties in Brazil.

Buying or selling a house should be rather straightforward. In fact, plenty of realtors will tell you that involving a lawyer isn’t necessary or even recommended. We’ve heard it before, yet how many times have you purchased a home in Brazil? Will you know if the property is encumbered or if the sellers have outstanding debts?

This is why we strongly encourage you to hire an advisor who is familiar with Brazilian property law. Your realtor may give you a contract; they may even help you through the myriad of documents you’ll need to sign. But remember, they have a financial incentive to close quickly. Ensuring you understand what you’re signing is not their priority.

What you need is someone who will review the purchase agreement for you. You need someone who will diligence the property and its owners to ensure there are no outstanding debts or liabilities. And you need someone who will review the deed to make sure you’re truly getting what you thought you were buying.

Doing business in Brazil is challenging and even more so if you’re a foreigner. Before taking the plunge, make sure you’re surrounded by advisors who are looking out for your best interests. It’ll pay off in the long run.
