Registering a Foreign Birth in Brazil

Last week we explained the process for Registering a Foreign Death in Brazil. It turns out that registering a foreign birth in Brazil follows nearly the same process. Again, there are two ways to do it: with and without a consular certificate.

The first option is to get a birth certificate from a Brazilian Consulate. You’ll get the certificate after you fill out the birth registration application form and schedule an appointment at the Consulate. Next, you’ll file the certificate with a Brazilian notary office. That’s all - it’s two steps, but they’re relatively simple.

The second option is to file directly with the notary office in Brazil. However, in this case, you’ll have to provide some other documents. In addition to a written request form, you’ll need originals and copies of personal documents, such as the foreign birth certificate and one parent’s birth certificate to confirm Brazilian nationality. These documents must be apostilled, translated by a certified translator, and registered in a separate notary office.

Keep in mind that anyone who isn’t born in Brazil and whose birth isn’t registered through a Brazilian Consulate must have their nationality confirmed by a federal judge when they turn 18 years old. To avoid this additional requirement, choose the first option and get a certificate from a Brazilian Consulate.

Here again, asking for help from a lawyer or service company can simplify the process. A professional advisor can ensure that all procedures are followed correctly, saving you time and potential legal complications in the future.
