Notarizing Documents in Brazil for Use in the US
In a past article, we wrote about how to notarize documents in the US for use in Brazil. But recently, we’ve been fielding questions about the opposite question: how to notarize documents in Brazil for use in the US.
The question as to “how” depends on the answer to “why”. That is, for what purpose is the document being used? If you’re signing real estate documents for a transaction in California, then your broker or whoever else is helping should advise you on the process.
One thing is for certain. Even if you can find a US notary public in Brazil, they likely are prohibited by their state from notarizing a document for you there. So save yourself some time and stop looking. Instead, consider one of the alternatives below.
A document that is notarized by a Brazilian notary generally won’t cut it. But if you get it notarized and apostilled, you should be in good shape. Both the US and Brazil are signatories to the Apostille Convention, so an apostilled document is recognized as valid in both countries.
Another option is to get the documents notarized by a consular officer at a US Embassy or Consulate. The cost for this service is US$50.00 per stamp. More information about notarization services, including a link to schedule an appointment, can be found HERE.
Finally, you might also consider an online notary service. These days there are plenty of e-notaries, and some provide services to customers outside the US.
Whatever option you select, just make sure that whoever needs the notarized document will accept the notarization process you choose.
